Supreme Court Strikes Down NC Cong. Districts

#1 Post by silverscreenselect » Mon May 22, 2017 9:27 am

A 5-3 decision said that two majority black districts had been drawn on racial lines, which was impermissible. What's interesting is the split. The four liberal justices were joined by Clarence Thomas in the majority, while Alito, Roberts, and Kennedy dissented (the case was argued before Gorsuch joined the court). Admittedly, since the lower court decision struck down the districting as well, a 4-4 split would have upheld that decision, but without precedential effect as this opinion by Justice Kagen has.

And last week they struck down North Carolina's voter ID law.

Technically, last week they declined to review the lower court case that struck down the ID law.

This was a full decision of the Court and carries a great deal more precedential weight.
