Good News for Redskins Fans

The Supreme Court today issued a unanimous ruling the Trademark Office can't deny a trademark on the basis that the term is merely offensive and not hateful. The case involved an Asian-American band called the Slants, whose stated goal in adopting that name was to reappropriate a derogatory term and use it as a mark of pride. The language in this decision would appear to cover the controversy surrounding the validity of the Washington Redskins trademark as well. The case was argued before Gorsuch joined the Court.

The problem, then, is that such calls do not address an opposition audience so much as they signal virtue. They talk past those who need convincing. They ignore actual facts and counterargument. And they are irreparably smug.
