Devin Nunes in 2010 reacting to protestors calling John Lewis the N-word:
I think people have every right to say what they want. If they wanna smear someone, they can do it.
By the way, Nunes' cow now has over 400,000 followers on Twitter, more than Nunes.

maliciously attacked every aspect of Nunes’ character, honesty, integrity, ethics, and fitness to perform his duties as a United States Congressman.” The attacks included accusing Nunes of racism, claiming he had obstructed justice in the Congressional probe on Russian political interference, and calling him a “treasonous cowpoke.”

Among the comments from Devin's cow during the last election campaign: "Devin’s boots are full of manure. He’s udder-ly worthless and it’s pasture time to mooove him to prison."

Obviously, California voters didn't do quite good enough a job of getting rid of the trash this last election. By the way, Devin's Cow had just over 1,000 followers before the lawsuit was filed yesterday and over 70,000 now.

Nunes has now filed another $150M defamation suit against Liz Mair, who was also a defendant in his first suit, and McClatchy Publishing, owners of his local paper, the Fresno Bee.
Nunes declared that McClatchy reporters need “to come clean with the American people” and retract their “fake news” reports. He said he wants such stories scrubbed from the internet and promised more legal challenges. "If you’re out there and you lied and you defamed, we are going to come after you,” he told [interviewer Sean] Hannity.

Nunes claims in the suit that the attacks on him were made, in part, to “interfere with and divert Nunes’ attention from his investigation of corruption and alleged Russian involvement in the 2016 Presidential Election.”
By Russian involvement, Nunes means his claim that they helped Hillary Clinton and did such a good job of it that (a) there's no trace of their involvement and (b) she didn't win. One good thing to come from all this is that Nunes and his lawyers may become very familiar with Federal Rule 11, which has to do with filing groundless and frivolous lawsuits.

He was careful not to file in California. That's because in California (even in the federal courts) his suit would have been subject to an anti-SLAPP motion that would likely have resulted in (a) quick dismissal and (b) an obligation to pay the defendants' attorneys fees. --Bob

Dammit, whenever this pops back up again for one of its brief lives (ha!), I get suckered into clicking on it, thinking it has something do with Neil Gaiman....

Oh, that's right, just some PMFF. Fool me once, etc....

The lawsuit has been dismissed by a federal judge:

Too bad the Post probably won't be able to recover its attorney fees.

Dismissed with prejudice, meaning it can't be refiled.

And let’s not forget the video that was deliberately edited deceptively near the start of the Obama Administration that resulted in an employee of the Department of Agriculture losing her job. I don’t remember any of the Bored’s conservatives complaining about fake news then, and that really was a case of actionable defamation. —Bob

It's more complicated than that. There's such a thing as a "limited purpose public figure." "A limited purpose public figure is one who voluntarily injects their views or is otherwise drawn into a particular controversy by their conduct; they are, therefore, treated as public figures when they sue for defamatory statements bearing on that controversy."

It can and certainly will be argued that Sandman was drawn into this controversy by his conduct.
Here's another case of a non-public person being vilified:

Family of slain DNC staffer can sue Fox News, appeals court rules

The law is different because Rich is dead and his parents are suing for emotional distress. Still, Fox News can't claim he's a public figure. The "conduct" that got him in the news was was not leaking DNC emails and getting shot.

Devin Nunes and his cow are back in the news as his lawyer has asked the judge in this case to hold Twitter in contempt for failure to reveal the identity of the cow and Devin's mother since Devin's legal team has been unable to do so as yet (presumably so they can personally serve them in this case). Twitter is resisting the motion, claiming immunity from online defamation lawsuits. Although the judge didn't issue a ruling, he appeared skeptical of Nunes' claimis.

Score one for the cow as the court has thrown out Nunes suit against Twitter for posting statements from the cow account like "Devin's boots are full of manure." Hopefully, Twitter will also recover a pretty penny in legal fees from Nunes as well. Meanwhile, Nunes' other lawsuits continue against Hearst, the Washington Post, CNN, and others.

I've gotta believe Nunes was at least smart enough not to file these abusive lawsuits in a jurisdiction with anti-SLAPP protections. I know that he filed in Virginia. I don't know whether Virginia has anti-SLAPP protections, but based simply on Nunes's choice of venue, I'm guessing it does not. --Bob
